What's
the difference between a civil traffic infractions and
criminal traffic infractions?
A
civil traffic infraction may carry a sentence
of points, driving school, suspended license,
court costs and fines. A criminal citation in
Florida may carry a jail sentence under Florida
Statutes. It is imperative to hire Forrest

In
Florida, pleading guilty and simply paying a Moving violation
traffic ticket will result in points being added
to your driving record. Too Many Points on your record
will lead to license suspension and also an increase in
your insurance premium and sometimes being dropped from
your insurance carrier. If your points reach a certain
level during any given period, your insurance premiums
will increase. If you receive 12 points within 12 months,
your driver license will be suspended for 30 days. If
you receive 18 points within an 18 month period, your
driver license will be suspended for 3 months. If you

be suspended for an entire year.

What may happen if you failing
to show up for your traffic ticket, or fail to follow
the legal requirements for handling your ticket ?:
A
Bench Warrant may issue
When
you are ordered to appear in court by a legal document
or a judge, you must appear. If you fail to appear,
a judge can sign a bench warrant asking for your
immediate arrest by the police. Police officers
may come to your home or workplace, but usually
you are arrested after being stopped again for a
new traffic offense. When the officer checks your
name and the status of your driver license he will
determine that there is a warrant for your arrest
and you must be taken into custody. Thereafter,
you must pay a bond or money to get out of jail;
or sometimes, a judge will refuse to let you out
of custody at all. After this happens, you must
then attend a court hearing in order for a judge
to determine your penalty. In some instances, you
can receive a jail sentence and be ordered to pay
a large fine. You may also receive a conviction
on your criminal record that stays there for life.

Suspended
licenses can occur several different ways. By failing
to pay a fine, failing to attend a court hearing,
receiving too many points on your driver license,
unpaid child support, fiancial responsibility, dui/drug
possession convictions or simply having no insurance
or allowing your automobile insurance to lapse.
If you are charged with driving with a suspended license
it can be a criminal or non-criminal offense. Driving
with knowledge that your license is suspended may
result in a criminal violation. If you did not know
that your license was suspended it may result in only
a non-criminal violation, sometimes referred to as
a civil infraction. |
Knowing
which one you are charged with is extremely important
in determining how it should be handled and on the future
consequences to your driver license. Whether you're charged
with or without knowledge of your suspension may result
in you incurring a "strike" on your license, which will
go towards you eventually being classified as a habitual
traffic offender.
In
Florida, if you accumulate 3 "strikes" within a 5 year
period your license will be revoked for 5 years as you
will be classified as a habitual traffic offender. Therefore,

What
if you get a Speeding Ticket?
Speeding
tickets usually carry the largest fines of all tickets.
However, speeding tickets are also the most likely
ticket to get dismissed when Forrest Freedman,

case. The reason for this is that the police officer
must use some sort of speed measuring device to monitor
your speed. It can be a pace clock, radar gun or laser
gun. The law requires that all of these speed measuring
devices be accurately calibrated before they can be
used. If the device is not calibrated and maintained
properly its use may be disallowed by the judge hearing
your case. It is best to have an experienced traffic
attorney who is familiar with all of these devices and
the rules and regulations that must be followed for
them to be used accurately. The attorney will point
out to the judge any mistakes and/or omissions
